Workers hurt when scaffolding collapses at North Carolina school

Scaffolding collapsed at a North Carolina high school on August 12th and this resulted in eight workers being injured. Due to the collapse it was reported that the injured workers fell 35 to 40 feet. Two of the workers needed to be airlifted to Mission Hospital.

Two of the workers had to be rescued by the Marion Fire Department as these workers were trapped under the rubble left from the collapse. Rescue workers also had to rescue a worker trapped on top of a cinder block wall. The rescue efforts for this individual took over an hour and placed the firefighters in a precarious predicament as well. It was reported that 70 emergency personnel will called to the scene with regards to the rescue efforts.

The Occupational Safety and Health Administration for North Carolina are currently investigating how the workplace accident took place. The work crew was engaged in the construction of a 60,000 square foot addition to the school at a cost of $8.5 million.

Considering the circumstances of what occurred here, this matter is likely going to be litigated. Litigation of these matters, however, can involve a number of areas of law.

Accidents of this kind could involve workers' compensation, personal injury or products liability claims. Determinations will need to be made as to what laws are applicable and whether OSHA regulations were indeed violated. And it will need to be determined whether the workers were properly trained, and whether adequate safety procedures were in place and were followed.

Many attorneys do not have the experience in this many areas of law. There will likely be more than one party sued for what occurred, and there may be a number of different theories as to what occurred. It is also important to determine precisely what did occur so these types of accidents can be prevented in the future.
